Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the TrendSweep mobile application ("App") or website ("Website"), collectively referred to as the "Service," you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and TrendSweep Inc. ("TrendSweep," "we," "us," or "our").

2. Description of Service

TrendSweep is a trend discovery platform designed to help content creators identify and leverage emerging trends on social media. Our Service includes:

  • Trend Discovery: Access to curated trending content and insights from social media
  • Content Recommendations: Personalized trend suggestions based on your selected niches, content styles, and goals
  • Analytics Insights: View example content with engagement metrics (views, likes, comments)

3. Account Registration

To access certain features of the Service, you must create an account using one of our supported authentication methods:

  • Sign in with Apple
  • Sign in with Google

By creating an account, you agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account.

4. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Provide false or misleading information
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated scripts, bots, or other means to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to our systems or networks
  • Engage in any activity that could harm other users or third parties

5. Subscription and Payments

TrendSweep may offer subscription plans that provide access to additional features. Subscriptions are billed through the Apple App Store and are subject to Apple's payment terms.

Subscription Terms:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscription in your Apple ID account settings
  • No refunds will be provided for any unused portion of the subscription term
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

6. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by TrendSweep Inc. and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute any part of the Service without explicit permission
  • Use our trademarks, logos, or branding without prior written consent
  • Create derivative works based on the Service
  • Remove or alter any proprietary notices or labels

Trend content displayed in the app (including social media content) remains the property of the original content creators. We display this content for informational and educational purposes only.

7. User Content and Preferences

By providing preferences, settings, and other information to the Service (such as your selected topics, content styles, and goals), you grant TrendSweep a non-exclusive, worldwide, royalty-free license to use this information to provide and improve the Service. You retain ownership of any content you create outside of the Service.

8. Third-Party Services

Our Service integrates with third-party services including:

  • Apple and Google: For authentication and sign-in
  • Apple App Store: For subscription payments and management

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of trend data or content
  • Warranties that using our trend recommendations will result in viral content or increased engagement

Social media trends are inherently unpredictable. We do not guarantee any specific results from using the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDSWEEP INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless TrendSweep Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You must stop all use of the Service
  • We may delete your account and associated data
  • Active subscriptions will continue until the end of the current billing period

You may terminate your account at any time by signing out and discontinuing use of the Service, or by contacting us to request account deletion.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrendSweep Inc. regarding the Service and supersede all prior agreements and understandings.
